Et celui qui, téméraire en sa conduite, n’obéirait pas à la décision du pontife établi là pour servir l’Éternel, ton Dieu, ou à celle du juge, cet homme doit mourir, pour que tu fasses disparaître ce mal en Israël;

MISHNAH: But the following are strangled1Since no particular form of execution is prescribed for them.: One who hits his father or his mother2Ex. 21:15., and one who kidnaps a person from Israel3In order to sell him or her as a slave, Ex. 21:16, Deut. 24:7., and the Elder who rebels against the Court4The Supreme Court sitting in the Temple court. Deut. 17:12., and the false prophet5Deut. 18:20–22., and one who prophesies in the name of foreign worship6Deut. 13:6., and one who copulates with a married woman7Deut. 22:22. This also applies to the woman., and the perjured witness of a Cohen’s daughter and her paramour8Even though the adulterous daughter of a Cohen is burned, there is no verse to apply the same punishment to the adulterer. Since witnesses to adultery are witnesses simultaneously to both parties, they cannot be punished more than the adulterer would be..
One who hits his father or his mother is not punishable unless he inflict a wound on them. The following is more aggravating about one who curses15Father or Mother; Mishnah 7:14. than one who hits, in that one who curses is punishable even after death, but one who hits after death cannot be prosecuted.

MISHNAH: The Elder who rebels against the Court, as it is said: If a law case is too difficult for you, whether blood and blood, or case and case, etc. Three courts were there, one at the entrance of the Temple Mount, one at the entrance of the Temple courtyard, and one in the ashlar hall. They come to the one at the entrance to the Temple Mount and he says, so I argued and so my colleagues argued, so I taught and so my colleague taught. If they had heard it, they tell them; otherwise they come to the one at the entrance of the Temple courtyard and he says, so I argued and so my colleagues argued, so I taught and so my colleagues taught. If they had heard it, they tell them; otherwise these and those come to the Supreme Court in the ashlar hall, for from there instruction goes out to all of Israel as it is said, from that place which the Eternal will choose.
If he returned to his town25The representative of the lower court who had been told by the Supreme Court that his opinion was wrong., repeated and taught as was his custom, he cannot be prosecuted. If he instructed to act, he is punishable, as it is said4The Supreme Court sitting in the Temple court. Deut. 17:12., but the man who would act criminally etc. He is not punishable unless he instruct to act. A student who instructed to act cannot be prosecuted; it turns out that his severity is his leniency26A person unqualified to judge who nevertheless judges commits a grievous sin, worse than the qualified judge who does not obey the rulings of the Supreme Court. But his punishment is reserved for Heaven, not the human court..

HALAKHAH: “They came and told her, your son died,” etc. 116The same text Giṭṭin, Halakhah 8:6. In both places, the problem discussed is not the one stated in the Mishnah. The parallel discussion in the Babli is 92a/b where there is no mention of the position of R. Jeremiah. If she should not have married but entered levirate, this is the case of a sister-in-law who married without ḥalîṣah. Rebbi Jeremiah said, this man performs ḥalīṣah, the other one keeps her. Rebbi Jehudah ben Pazi in the name of Rebbi Joḥanan: She must leave117This is a rabbinic decree since the outside marriage of a woman under obligation of levirate is invalid (Chapter 1, Notes 93, 94); therefore, the widow was not legally married during the levir’s lifetime and how can you leave a nonexisting marriage?. Rebbi Yose in the name of Rebbi Hila: She must leave. Rebbi Yose asked Rebbi Phineas, how does the rabbi hold? He said, with Rebbi Jeremiah. He said to him, change your mind, for otherwise I shall publicly call you a rebellious Elder118Deut. 17:12.. Rebbi Zevidah said, a baraita119Cf. Tosephta 11:8, Giṭṭin 8:6. supports Rebbi Joḥanan: “She must leave both of them and the thirteen items120Enumerated in Mishnah 1. apply to her, following Rebbi Meïr who said it in the name of his teacher Rebbi Aqibah. But the Sages say, there is no bastard from a sister-in-law121Cf. Halakhah 4:15..” They only said, “there is no bastard from a sister-in-law,” therefore she must leave. And we have stated, “she must leave”. And Rebbi Joḥanan said, she must leave.
