כי יכרית, “When He will cut down, etc.” Nachmanides writes that the basic legislation (Exodus 21,13) following had already been made public, Moses now elaborates on it.
Ramban
WHEN THE ETERNAL THY G-D SHALL CUT OFF THE NATIONS etc. 2. THOU SHALT SEPARATE THREE CITIES FOR THEE. This also is an explanatory commandment, since He has already commanded thereon,239Exodus 21:13. and now he went on to explain the ordinances thereof, saying and dwell in their cities, and in their houses,240Verse 1. teaching that they are not obligated [to set aside the cities of refuge] until after taking possession of the Land and dwelling in it. And so Joshua did.241Joshua, Chapter 20. He also added here, Thou shalt prepare thee the way,242Verse 3. meaning that the roads leading thereto should be direct [without being unnecessarily circumflex], and that [signs reading] “Refuge, Refuge” be set up at the crossroads. So also he added and thou shalt divide the territory of thy Land into three parts242Verse 3. [meaning, that the cities shall be equidistant from the frontier and from each other]. And he also went on to teach us [the rules of] the matter of “error” [which require the unintentional murderer to seek refuge] as he said, And when a man goeth into the forest with his neighbor etc.243Verse 5. Our Rabbis have based many more interpretations on this section.
Rashi
מיד איש אחיו AT THE HAND OF EVERY MAN’S BROTHER — At the hand of a man who loves him like a brother and slays him accidentally will “I” require it, unless he go into banishment (in one of the Cities of Refuge) and pray for forgiveness for his iniquity. For even one who kills another by accident needs atonement: therefore if there are no witnesses to the deed to make him liable to banishment and he does not humble himself, the Holy One, blessed be He, will require it of him, just as our Rabbis explain the text, (Exodus 21:13) ‘‘But God causes it to come to hand”, in Treatise Makkot (Makkot 10b): The Holy One, blessed be He, causes them (the man who killed by accident and had not expiated the murder and the man who killed with premeditation) to meet at the same inn. The former in ascending a ladder falls upon the latter and kills him and has therefore — the accident having been seen by men — to go to banishment.

No...will befall Heb. לא תאנה, will not happen. Similarly, (Exod. 21:13): “and God allowed it to happen (אנה) to his hand.”

And the men took of their provisions. They accepted their words. They trapped them with their mouths,10The men of Yisroel were taken in by their trick. as it is said, “But if he did not set an ambush.”11Shemos 21:13.

From the wicked comes wickedness.9So let it not come from me even if you deserve it.—Radak. The Holy One, Blessed is He, destines the wicked to fall into the hand of the wicked like himself. And where did the Torah say this, "And God destined it into his hand,"10Shemos 21:13. as it is stated in Maseches Makos.11
